The government of Rio de Janeiro filed a Direct Unconstitutionality Action this Thursday (/) in the Federal Supreme Court, questioning article of the Petrobras Capitalization Law. According to the state's Press Office, a favorable decision will mean an increase of “billions of reais” in state revenue from oil exploration on the coast of Rio. The information is from Portal G .
Through the action, the state of Rio requests special shares in the five billion barrels of pre-salt oil transferred to Petrobras, which served as the basis for the company's capitalization. According to G , the Federal Attorney General's Office reported this Saturday that it is awaiting a subpoena regarding Adin, however, it added that it will defend the legitimacy of the law that allowed Petrobras to operate.
The payment of “special contributions” to oil-producing states, as a way of compensating producing states with exploration resources, is provided for in the Petroleum Regulatory Framework of the Federal Constitution.
Unlike royalties, which are charged on the value of Austria Phone Numbers List production, special participations are collected on the net profit that the oil company makes from quarterly production in a given field. This type of payment occurs in cases where the volume of oil is very large or has prospects of great profitability. The special participations are divided between the Ministry of the Environment, Mines and Energy, the states and the producing municipalities.
Impact on public accounts
According to G , if the STF decides in favor of Rio de Janeiro, the state's public accounts will suffer a major positive impact, as in September the government received R$ billion from Petrobras for the onerous assignment of five billion barrels of oil.
The extra revenue resulted in a primary surplus (savings to pay interest on public debt) of R$ billion in government accounts in September, a historic record for all months. Without this contribution, the coffers would have a deficit of R$ billion in the month before last, which would be the worst result since September – when there was a negative primary result of R$ billion.
